WA – New security of payments laws
The Building and Construction Industry (Security of Payment) Act 2021 (the Act) provides important payment protections for all participants in the Western Australian building and construction industry (some exclusions apply). It applies to construction contracts entered into on or after 1 August 2022.
To prepare for the new laws, Building and Energy has produced a range of educational materials to help participants in the WA building and construction industry understand when and how the Act will apply to their construction contract.
These educational materials are suitable for subcontractors, head contractors, builders and suppliers.

Further information will be made available as the Act comes into effect on Monday 1 August 2022. The Construction (Former Provisions) Contracts Act 2004 will continue to apply to contracts entered into prior to this date in Western Australia.
