Need your comments by Wednesday 9th August 2023 re Building Bill 2023

Dear ACRA Members

As you are aware the building industry in NSW is going through major legislative reform, and part of this reform is the new licensing proposals.

Recently the ACRA NSW subcommittee has attended roundtable discussions on the new licensing proposals which include General Framework Licensing, Builders Licensing and Specialist Licensing.

You will find attached to this email the documents “Building Bill 2023 – Licensing Proposals – Paper” and “Building Bill 2023 – Licensing Proposals – Attachment Paper”.

These documents outline the Department of Customer Service’s policy positions on the framework for building and construction licensing in NSW.  They will guide ongoing conversations about the framework structure and key elements; which licenses will be captured in the framework; and how the framework will reflect the day-to-day work of industry practitioners.

You will also find attached documents “Slides – from the roundtables” which is a document that combines the slides from the discussions that occurred on the 18th July 2023, 25th July 2023 and the 27th July 2023.

Some of the major changes include 4 new categories for the builder’s license which now include:

  • D – Internal fit outs (non-structural building work and fit-outs);
  • C – Low rise (work on class 1 and class 10 buildings);
  • B – Medium rise (work on any class of building up to 3 storeys);
  • A – Unrestricted – high rise (work on any class of building);

Note: Waterproofing will also become specialist work that will require licensed operators to carry out this work.

The Department of Commerce has provided a word document called “Building Bill 2023 – Licensing Proposals – Answer Sheet” which is attached and outlines a list of various questions relating to the Bill.  We have vetted the questions that we believe relate to our members and have provided our response in the document attached “Building Bill 2023 – Licensing Proposals – ACRA RESPONSE”.
